Terms of Service for GifChat

1. Acceptance of Terms

Welcome to GifChat. These Terms of Service (“Terms”) govern your access to and use of the GifChat mobile application (“GifChat,” “the app,” “we,” “us,” “our”), operated by Cezar Drumea, an individual based in Romania.

By creating an account or using GifChat, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the app.

2. Eligibility

You must be at least 16 years old to use GifChat. By using the app, you confirm that you meet this age requirement. If we learn that a user is under the minimum age, we may terminate their account.

3. Your Account

• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate information when creating your account.
• You may not impersonate others, create accounts for abusive purposes, or share your account in ways that violate these Terms.
• You can delete your account at any time from within the app.

4. How GifChat Works (AI Processing)

GifChat uses artificial intelligence to turn your text into reaction GIFs. To provide this, the content you type — including messages and conversation context — is processed by third-party AI providers (OpenAI and Anthropic). By using GifChat’s messaging and GIF features, you acknowledge and agree to this processing, as described in our Privacy Policy.

5. User Content

Your content: You retain ownership of the content you create and share on GifChat (your posts, messages, comments, captions, and other contributions, collectively “User Content”).

License you grant us: By posting User Content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute that content solely for the purpose of operating and providing the app (for example, showing your posts in feeds, delivering your messages, and displaying your stories). This license ends when you delete the content or your account, except where the content has been shared with others or is retained in anonymized form as described in our Privacy Policy.

Your responsibility: You are solely responsible for your User Content and the consequences of posting it. You represent that you have the rights to the content you post and that it does not violate these Terms or any law.

6. Acceptable Use / Prohibited Conduct

You agree not to use GifChat to:

• Post or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, hateful, or that incites violence.
• Post sexually explicit content, content involving minors, or any content that exploits or endangers children.
• Harass, bully, intimidate, stalk, or threaten other users.
• Impersonate any person or entity, or misrepresent your affiliation.
• Post spam, scams, or misleading content.
• Upload viruses, malware, or any code intended to harm the app or other users.
• Attempt to gain unauthorized access to the app, other users’ accounts, or our systems.
• Scrape, harvest, or collect other users’ data without authorization.
• Infringe the intellectual property or privacy rights of others.
• Circumvent or interfere with the app’s security, rate limits, or content moderation.
• Use the app for any unlawful purpose or in violation of these Terms.

7. Content Moderation and Enforcement

• We use automated content moderation (including AWS Rekognition) to detect prohibited content in uploaded images and videos before they are published.
• We reserve the right, but are not obligated, to review, monitor, remove, or restrict any User Content, and to suspend or terminate accounts, at our discretion — including content or accounts that violate these Terms or that we consider harmful, without prior notice.
• We may report illegal content or activity to law enforcement.
• You can report content or users through the in-app reporting features.

8. Termination

• You may stop using GifChat and delete your account at any time.
• We may suspend or terminate your access to GifChat at any time, with or without notice, if you violate these Terms, if required by law, or to protect the app or other users.
• Upon termination, your right to use the app ends. Provisions that by their nature should survive termination (such as content licensing for already-shared content, disclaimers, and limitations of liability) will survive.

9. Third-Party Services

GifChat relies on third-party services (including OpenAI, Anthropic, AWS, Supabase, Railway, Expo, and Stripe) to operate. We are not responsible for the practices of these third parties. Your use of the app may be subject to their terms and policies.

10. Disclaimers

GifChat is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that GIF matches, content, or features will meet your expectations.

We are not responsible for User Content or for the conduct of any user. Interactions between users are solely between those users.

11. Limitation of Liability

To the maximum extent permitted by law, Cezar Drumea and GifChat will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the app, even if advised of the possibility of such damages.

To the maximum extent permitted by law, our total liability for any claim related to the app will not exceed the greater of (a) the amount you paid us, if any, in the 12 months before the claim, or (b) €50.

12. Indemnification

You agree to indemnify and hold harmless Cezar Drumea and GifChat from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your User Content, your use of the app, or your violation of these Terms or any law or third-party rights.

13. Changes to These Terms

We may update these Terms from time to time. We will update the “Last updated” date and, where appropriate, notify you in the app. Continued use of GifChat after changes means you accept the updated Terms.

14. Governing Law

These Terms are governed by the laws of Romania, without regard to conflict-of-law principles.
